Conditions of Enrolment Print

The student, in signing the Application form, agrees to adhere to the conditions as outlined below.

Enrolment
  • All courses offered by ANU College are subject to entry requirements;
  • Students are required to purchase their textbooks (if required) within the first two weeks of class;
  • Under the National Code of Practice 2007, students who fail 50% or more of their classes in one semester in the ANU College Foundation Studies program are not able to continue with the course;
  • Students are governed by the policies and procedures of ANU College, guidelines as set out in the Student Handbook and Appendices, and the laws of Australia. ANU College may suspend or cancel a student's enrolment where the student has not followed the rules, policies and conditions of the College;
  • Timetable and course structure are subject to change at any time without notice;
  • Students are to respect the rights of other students and teachers and actively create a constructive learning environment;
  • The student agrees to take full responsibility for his/her own personal belongings, including laptop computers, cameras, and text books, and releases ANU College for loss or damage to such items;
  • A student who does not meet their financial obligations throughout their enrolment may be suspended from their program until they have paid the fees due;
  • A student who withdraws or completes a course but has not paid all the fees for that program will not be issued with their graduation certificate until such monies have been paid in full. For Foundation Studies students who are required, and have agreed to, undertake an additional subject or period of study, will be required to pay the appropriate fees in full as invoiced. Failure to do so will result in their final grades and graduation certificate being withheld.
  • Overseas students are required to supply their home country permanent address to meet Australian Government reporting requirements;
  • Overseas students are responsible for obtaining a passport and a relevant visa that permits them to study in Australia for the duration of their course and must abide by the conditions attached to their visa;
  • ANU College has the right to check a student's visa status and study entitlements with the Department of Immigration, and ANU College may report any suspected breaches of visa conditions to the Department. This may result in cancellation of the student's visa;
  • Students are responsible for the full costs of their course, as well as travel and living costs for themselves and any dependents;
  • Overseas students studying on a student visa are required to pay and maintain Overseas Student Health Cover (OSHC) while studying in Australia;
  • Student personal information, including personal and contact details, course enrolment details and changes, and circumstances of any suspected breach of visa conditions, may be shared with the Australian and State Governments, designated authorities and the Tuition Assurance Scheme and the ESOS Assurance Fund Manager. Information may be also be shared with the ANU and any part thereof, our Homestay providers, agents and family members;
  • The student agrees to pay all fees in advance as per the Letter of Offer before course commencement;
  • ANU College has the right to withdraw an Offer if the student does not meet the conditions of acceptance or if the College does not receive their course fees and the Acceptance Agreement before program places have been filled, or if the College does not receive the course fees within the period set out in the Letter of Offer;
  • Providing false or misleading information may result in the non-acceptance or cancellation of enrolment;
  • Students must attend orientation sessions prior to starting their course. Arrival after the commencement date may result in the enrolment being cancelled.

Attendance

  • The student agrees to attend all classes. In cases where the student is unable to attend class for two consecutive days, ANU College requires the student to provide a medical certificate from a doctor;
  • The Australian Government requires student visa holders to attend 80% of their course. Poor attendance will be reported to the Department of Immigration and Citizenship (DIAC) which may result in the student being asked to leave the country.

Student Welfare

  • The student understands that excursions are optional and may incur an additional participation fee;
  • The student understands ANU College will strive to ensure the safety and well being of students participating in any excursion/sporting event/social activity arranged through the College;
  • The student (or parent/guardian if student is under the age of 18) gives consent to, and accepts all risks resulting from participation in the College's excursions/sporting events/social activities that could result in injury, permanent injury, and loss of life or belongings becoming lost, damaged or destroyed. In addition, the student releases the College and all persons associated directly or indirectly with the excursions/sporting events (‘the indemnified') from all claims, demands and proceedings resulting from participation and indemnify the indemnified against all liability (including liability for their negligence and the negligence of others) for all injury, loss or damage connected with participation in the excursions/sporting events.
  • The student (or parent/guardian if student is under 18) authorizes ANU College or its staff to seek emergency medical treatment by a hospital, medical practitioner or ambulance service in the event of an emergency. All costs associated with this will be borne by the student (or parent/guardian if under 18).

Change of Address

The student MUST notify ANU College if they change their address and/or contact telephone numbers within 7 days of the change.  For student visa holders, if ANU College does not have a current address for a student, then their visa could be automatically cancelled without their knowledge.

ANU COLLEGE REFUND POLICY

This statement sets out the policy under which refunds may be made for the fees paid by international students and includes general refund policies which relate to all these fees.  Students need to be sure they have read and understood in full ANU College's refund policy for international students, as set out below.  Full details are available at www.anucollege.edu.au

Policy

Students will qualify for a refund depending on the category of their situation.  Such situations are covered by the provisions of the Education Services for Overseas Students Act 2000 (ESOS Act 2000) and are detailed in the section ‘Qualifying for a Refund' below.

Definitions

Program: A program is the total length of the course that appears on the letter of offer or electronic Confirmation of Enrolment (eCOE) from ANU College.

Foundation Studies: The Foundation Studies Program consists of two or three semesters, per the student's letter of offer.  A semester is between 14 - 17 weeks of tuition.

ELICOS: ELICOS stands for English Language Intensive Courses for Overseas Students. A program in ELICOS consists of one or more modules, per the student's letter of offer.

Module:  Until Nov 2010 one module is 5 weeks of ELICOS tuition, thereafter each module is 7 weeks of ELICOS tuition.

ANU College: ANU College is a registered business name of ANU Enterprise Pty Limited (ANUE). ANUE is the CRICOS-listed company that will refund any fees due.

Withdrawal: Withdrawal is notice in writing of cancelling the enrolment.  Withdrawal also includes leaving the program as a result of unsatisfactory academic progress, attendance below 80% or failure to comply with relevant College student policies.  Withdrawal also includes a category 1, 2 or 3 as detailed in the table below.

QUALIFYING FOR A REFUND

Students will qualify for a refund depending on the category of their situation.

CATEGORY 1:  The Offer is withdrawn by ANU College or the Program is unable to be provided by the College prior to the commencement date. The student will receive a full refund of tuition fees.  There is no refund of the late application fee (if this was applicable).

CATEGORY 2:  The student cancels or withdraws prior to the commencement date of the Course, as outlined in the Offer Letter; the student's visa application is refused; the student does not meet any one of the conditions stated in the Offer Letter, or the Offer was made on the basis of incorrect, false or incomplete information supplied by the Student. The student will receive a full refund of tuition fees; however, an administration fee of AU$450 will be charged.  There is no refund of the late application fee (if this was applicable).

CATEGORY 3:  The student withdraws from the program after the commencement date, as outlined in the Offer Letter. The refund given is dependent on the course the student is enrolled in.

  • ELICOS & ANUC Foundation Studies program: 50% of the unused modules / semester/s fees, provided withdrawal is before the unused modules / semester/s commencement date. There is no refund of the late application fee (if this was applicable).
  • Access English courses: There is no refund of tuition fees or the late application fee (if this was applicable).

Overseas Student Health Cover (OSHC) Refund

Refund of OSHC premiums can only be considered in accordance with the refund policy of OSHC Worldcare - www.oshcworldcare.com.au

TRANSFERRING OF FEES BETWEEN PROGRAMS

This policy refers only to circumstances in which students change courses within ANU College or between ANU College and The Australian National University (ANU).  Students require permission from the appropriate Heads of Programs to transfer from one ANU College study program to another and from the Heads of Program and ANU Admissions Office to transfer to ANU programs.

ANU College Programs

Where an overlap of courses occurs so that a student needs to transfer from one course to another, for example ELICOS to Access English, then unexpended funds paid for the initial course should be transferred to the receiving course.  Any fees remaining after payment of the receiving course fees may be refunded to the student on application, less a bank charge of AU$30.00.

ANU College to ANU Programs

Students reaching ANU entry requirements and commencing at ANU before completing ANU College courses will receive a full pro-rata refund of unexpended College fees calculated from the start date of the ANU course, less a bank charge of AU$30.00.  ANU College cannot transfer fees across to the ANU on behalf of the student.

GENERAL PROCEDURES FOR ALL THE ABOVE FEES

1.    Refund applications must be made in writing and addressed to The Manager, Student Administration, ANU College.  The Refund Application form is available on the ANU College website:  www.anucollege.edu.au;

2.    The date of withdrawal is the date on which ANU College receives written notification of withdrawal;

3.    Refunds will always be made in Australian dollars, converted to the currency of the student's home country when there is an overseas bank account.  ANU College will not be responsible for any cost associated with currency conversion or currency exchange fluctuations.

4.    If a student is eligible for a refund of fees that were paid using a credit card, the refund may be credited back on to that credit card.

DEFERMENT OF STUDIES

Under the requirements of the ESOS Act 2007, if an overseas student has enrolled in a program at ANU College, the registered provider (ANUC) must not allow them to defer commencement of their studies, or suspend their studies, except on the grounds of illness evidenced by a doctor's certificate, or other exceptional compassionate circumstances beyond the control of the student, for example, bereavement.  If a student defers or suspends their studies on any other grounds, the registered provider must report the student to DIaC via PRISMS, as not complying with visa conditions. Student Visa holders need to be aware of the implications regarding their student visa status as a result of taking a Deferment of Course.

Deferment of Course Procedure

ANU College enrolled students studying on a Student Visa need to follow this procedure to defer their studies.  All applications for Deferment of Course must be made in writing and must include all the relevant documentation.  Applications are to be forwarded to the Manager, Student Administration, ANU College.  Once a deferment of course has been approved, the student has 28 days to return to their home country.

Granting a Deferment of Course

Documented medical grounds or exceptional compassionate circumstances are the only grounds acceptable for approval of an application (Standard 13 - National Code).

1.    An illness or disability (certified by a licensed medical practitioner or registered psychologist);

2.    Exceptional compassionate circumstances - for example, the death of a close family member (parent, grandparent, sibling, spouse or child);

3.    Major political upheaval or natural disaster in the home country requiring emergency travel and this has impacted on the student's studies;

4.    A traumatic experience that has impacted on the student (supported by police or psychologists' reports) - for example, involvement in, or witnessing of an accident; or witnessing or being the victim of crime.

Deferral and Refund Policy

A student who suspends or defers their course after the commencement date and subsequently withdraws from the course and requests a refund will be placed in a Category 3.

DISPUTES

Where there is a dispute between a student and ANU College regarding entitlements under this refund policy, attendance, code of conduct, or the quality of the products and services of ANU College, attempts will be made to negotiate a settlement before resorting to external dispute resolution mechanisms, including allowing the student to refer the matter to the Principal and General Manager, ANU College, to intervene and direct some form of resolution.  A student is entitled to appear on his or her own behalf, and may be accompanied by a person nominated by the student, or may ask the nominated person to represent him or her at any negotiation to resolve a dispute under this refund policy.

If a dispute remains unsolved after attempts at negotiation or after 20 business days, whichever is the lesser, ANU College and the student will submit the dispute to a mutually agreed upon external mediator.  If a dispute is not settled within a further 10 business days, the matter will be referred to arbitration with an arbitrator nominated by the Chairman of the ACT Chapter of the Institute of Arbitrators and Mediators Australia.  Both parties are to meet their respective costs associated with mediation.

This arrangement does not remove the right of the student to take further action under Australia's consumer protection laws. In addition, a student may commence legal proceedings relating to any dispute at any time.
